Terms and Conditions

GENERAL
Expert Joinery Ltd. (“we” or “the seller”) sell goods and service to (The customer who placed the order) on the terms set out below. No other terms shall apply between the Company and the Customer and may not be varied expect by the written consent by an authorized office of the Company. The giving of any delivery instructions, the acceptance of any payment of goods or service or any conduct in confirmation of the transactions hereby contemplated shall constitute acceptance by the customer of these conditions. No work will be undertaken until a 50% deposit is placed. Our estimated delivery time for doors and windows is 4 to 10 weeks and subject to the conditions laid out under Delivery Service (below).

QUOTATION AND PRICE
Quotations are normally open for acceptance within 4 weeks from the date however, are subject of confirmation in writing by the Company at the time of such acceptance. Quoted prices do not include Value Added Tax, which will be added, where applicable, at the appropriate rate at the time of invoicing. Prices do not include installation. The price quoted is subject to our final survey. In the event that there is a revision in your requirements or there is an alternation in the specifications or if in the unlikely event for any reason, we are unable to manufacture the requested joinery at the price(s) provided, we reserve the right to re-quote.

PAYMENT
After the customer has agreed on an estimate with the sales team, we require a 50% deposit of the total estimated amount to secure your booking and send out a site surveyor to take measurements. Once your goods have been received here in the showroom the remainder of the balance on the estimate is to be resolved 3 days prior to your delivery date. No goods will be released by Expert Joinery or any persons if full payment has not been received 3 days before your delivery. Any failures to pay will result in a delay in your order being sent out and received and will delay your project and delivery date. Failure to make payment will result in additional charges and we hold reserve all rights to reschedule your delivery without notice.

LEAD TIMES
Our current lead time, from receiving the deposit and signed order form to the delivery date of the ordered items is 4-10 weeks. Occasionally, this can be subject to change. However, we will advise you on that at the time of placing the order.

ORDER CONFIRMATION
Please check your order invoice and or quote, survey sheet and any production drawings provided carefully and contact us immediately by email or phone if there are any corrections required. The information on our documentation is what is provided to the factory for production. Orders cannot be amended once they have been placed with the factory. We will send you a order confirmation electronically and no order will be placed until we receive full confirmation in writing to confirm your order, regardless of deposits being in our accounts.

SURVEY
The The first stage of our cooperation with The Customer is to conduct a survey which date is previously arranged. We as a company will strive to approach and or enter the property/site to take necessary values and notations to avoid any complication this will be consented prior to the ordering process. Our surveyor will potentially have many appointments on the same day, and he may be held up, so it is not possible to give a precise time of his arrival. All survey sheets and guidelines are presented, agreed and signed by The Customer and it is important that The Customer follows our company guidelines. If our surveyor advises that installation is not feasible for any reason, we will notify you in writing and will return any deposits if paid and the agreement will come to an end without further obligation. We are unable to accept responsibility for faulty measuring by third party. If you instruct us to manufacture any doors/windows to a size based on provided sketches, architectural drawings or drawings which you may have provided by text, email or post which you have signed off on, we can in no way be held accountable for incorrect supply if the windows/doors match the location, dimensions, detail, design and specification provided by the customer.

CANCELLATION SECURITY AND INTEREST
Order cancellations cannot be accepted past the end of the next working day when the deposit was paid by The Customer. Beyond this no cancellation
in whole or in part can be made by The Customer without The Company consent which is normally granted in the event The Company cancels any relevant order with its own supplier. If The Customer still wish to cancel his order The Company has the right to keep the deposit and The Customer is obligated to cover all the expenses and the charges incurred by The Company and The Company’s loss of profit on the order. Since the goods are manufactured
to fulfil the customer’s requirements, in the event of a cancellation, the Company may be unable to re-sell the goods or any part thereof at a better than scraps value and the purposes of calculating the Company’s loss or profit.

DELIVERY SERVICE
We will contact The Customer when we have ordered goods in stock to give a delivery date and to arrange fitting (where applicable). The Customer is obligated to provide the remaining payment upon the invoice 3 days prior of delivery day to The Customer site. The lack of payment confirmation will result in the refusal to deliver / unload the ordered product. Non delivered goods will be charged a rearranged 2nd delivery of £65 and a 3rd delivery of £100 maximum. Additional delivery charges are to be paid in advance. It is entirely at the driver’s discretion to assist in offloading a delivery. The Company shall not be liable for any delay in performing or failure to perform any of its obligations in relation to the Goods arising from circumstances beyond its control. Non exhaustive illustrations of such circumstances would be strikes, war, riot, explosion, abnormal weather conditions, fire, flood, lockout, Government action or regulations, delay by suppliers, accidents and shortages of materials, labor or manufacturing facilities. In case of delivery delays for the reasons mentions above Expert Joinery Ltd is not responsible for securing The Customer’s property by supplying, installing or paying for replacement door or windows. If such delay or failure persists for more than 3 months then either party shall be entitled to terminate the agreement but The Customer shall remain liable to pay for goods delivered prior to the date of such cancellation.
The defect is to be reported as soon as reasonably practical upon which the discovery of the defect ought reasonably to have been made. Notification of claim under warranty can be by phone, initially and then backed up by written notice within 14 days to the Company. This written notice can be by post or email. When making a claim please quote your invoice number, date of invoice, full name and address and the product and room location for which you are making the claim.

STORAGE
From the date upon arrival of your doors or windows, we will store these free of charge for a duration of no longer than two weeks (fourteen days), thereafter £30 will be charged per day.

MAINTENANCE
Regular maintenance will ensure your door stays in good condition for many years. Check the condition and if appropriate apply the finishing materials in accordance with the manufacturers’ instructions.
The placing of an order by the customer shall indicate acceptance of these Terms and Conditions and their reasonableness.

ADVISING OF SHORTAGES / DAMAGE & FAULTY GOODS
The Customer is obligated to check the goods supplied and notify us of any faults. If a fault rather than defect develops after a door is fitted, written notice of the fault must be sent to us within 6 weeks from the date of installation/delivery. In the event of the goods requiring replacement, the liability of Expert Joinery Ltd shall not exceed the replacement value of the faulty goods. Expert Joinery Ltd. shall not be responsible for any incidental work or expenses arising out of or because of any defect in our product, or bad workmanship applied to our products. We reserve the right to repair or replace the said product.

constitutes irrevocable acceptance of the goods.

WEBSITE IMAGES AND COLOURS
Images and timber colours on our website and in our brochures are used to represent the design of doors and windows. Designs and colours of the images should not be taken as a true reflection of the doors and windows that we would deliver. We would always advise you to visit our showroom for a better representation of colour and design. Timber is a natural product and therefore is liable to colour variations. Manufacturers and suppliers try to colour match the timber in each door but are not able to give a guarantee that one door will match another.

GUARANTEES
Once The Customer has paid the full price due, pursuant to these Conditions. The customer will be entitled to the benefit of a “Guarantee” in respects of certain Goods.
The Guarantee depends on the legibility of the good’s supplier. Moreover, will be required to have a valid receipt. The Guarantee period will commence on the date on which the Goods are delivered. Goods provided as replacements under the Guarantee will be subject to the original Guarantee period. The guarantees only stand from the original date and not the date any replacement was installed/supplied. Due to the length of guarantees offered; we cannot guarantee that any part being replaced will match the faulty item being replaced but where possible, we will try to match items like for like. Where you own the property to which the Goods are being fitted, this Guarantee is transferable should you sell your property.

FITTING GUIDELINES
Expert Joinery Ltd. offer complete supply and fitting on nearly all our doors and windows. Expert Joinery Ltd. use trusted carpenters to offer the best carpentry for the fitting of internal and external doors, windows or kitchen furniture. We only install products purchased from us. We would like to confirm that we provide doors of described and ascertained measurements which in turn require openings of defined measurements in relation to the door. The measurements of each door opening must be followed exactly to allow the correct fitting of each door. We will take responsibility of our product only if the stated door opening measurements are followed accurately by our guidance. To confirm that the required door opening measurements are correct and have been understood, The Customer is required to confirm by signature the Survey Sheet.

RESPONSIBILITY
The Company’s workmen are instructed to exercise due care and attention in completing their work and The Company will not accept responsibility for damage to the fabric or the contents of the buildings or the work of other trades however caused.
Whilst utmost care is always taken to minimize damage to surrounding areas, it must be appreciated that when removing old installations (door and door windows) there is to be expected some minimal difference to existing decorations which is not the responsibility of our company to rectify.
Door and door frames purchased from Expert Joinery Ltd. May not be identical size to those removed from Customer property and therefore it is expected that there may be some gaps between architrave, skirting and carpets. This is not a fault or defect in manufacturing or installation nor any negligence or lack of care on our part. For this reason, it is vital that the finishing treatment may need to be applied around the area (internal and external) where the door was installed.

The Company will not be liable for any fixing charges incurred by The Customer arising from any goods or materials or work done proved to be defective or delayed and shall not be responsible for any additional overheads, administrative expenses, contractual penalties or other cost, claims and demands arising from the Customer’s obligations to any third party and due indirectly or directly to any defects or delays in the goods or materials supplied or work done by The Company. The Customer accepts that it is their responsibility to insure against these risks. Any alleged shortage, delay, damage or defect shall not constitute valid grounds for The Customer to delay payment in respect of the goods delivered and for the avoidance of doubt The Customer shall be required to pay for all goods and material supplied.

QUALITY
The goods or materials supplied are on the basis that they conform to the written descriptions contained on the order or confirmation where supplied. No warranty can be given that the goods or materials supplied conform to the sketch plans or drawings provided too the Company by The Customer or to illustrations or descriptions in catalogue or trade literature. If The Company provides estimates of quantities or measurements based on drawings and/or Bills of Quantities and/or specifications submitted by The Customer, The Company shall exercise reasonable care in providing such, but The Company accepts no liability for inaccuracies in the estimates or calculations. Any goods manufactured to the design or specification of The Customer or its experts or detail taken off plans supplied by The Customer are produced without warranty of any kind except their compliance with the design or specification.
The Customer will unconditionally fully and effectively indemnify The Company in respect of any claim, cost or expenses, losses or demands resulting there from including the infringements of patent, copyright, design, trademark or any industrial or intellectual property rights resulting from The Company’s use of the said design or specifications. Confirmed orders are based on the plans and specifications supplied by The Customer were applicable. The Customer shall check the specification and quantities quoted and shall be deemed to have accepted the specification and quantity specified when placing the order. The Company will not accept responsibility for incorrect specification and quantity supplied by The Customer. The Customer is deemed to be fully conversant with the nature and performance of the goods and materials supplied to it including any harmful, hazardous or dangerous effects resulting from their usage or misuse and shall not be reliant in any way upon the advice, skill or judgement of The Company or its servants, agents or employees who are not authorized to make any representations concerning the goods whatsoever other than those confirmed by the Director of The Company in writing.
To the extent that any third-party goods or services supplied to The Company validly excludes, restricts or limits its liability to The Company in respect of goods or materials supplied or any loss or damage arising in connection therewith then the liability of The Company to The Customer in respect of such goods and materials shall be correspondingly excluded, restricted or
limited. The Customer shall be entitled to receive details of any such exclusion, restriction, or limitation upon request to The Company. If the materials are supplied to The Customer of a specified grade no warranty is given that the grade will be suitable for the purposes required by The Customer.

Installation
Installation costs must be cleared when the job is finished and no later than 3 days after installation has been completed. Unless stated otherwise installation services will only entail the installation of products, no trimming, painting, finishing or any other jobs will be undertaken unless agreed upon prior to the installation work being undertaken.

ENFORCEABILITY
Should any provisions of these terms and conditions be held by a competent authority to be invalid or unenforceable in whole or in part then the validity of the remaining provisions shall not thereby be affected.

JURISDICTION
This document shall in all respects be construed and operate as an English contract and in conformity with English Law and The Company and The Customer agree to submit to the jurisdiction of the English Courts. Expert Joinery Ltd.
